  1. III. SCOPE AND CHANGE OF TERMS

These general terms of sales apply to all orders placed on the websites www.evinite.com, www.evinite.fr, www.evinite.de, www.evinite.es, www.evinite.ru, www.evinite.cn, www.evinite.se, www.evinite.pl and more generally to any order placed to SARL Evinité. The terms of sale are on the homepage of the Evinité website. The customer can click on the link for the general terms of sales even before processing the order. Accordingly, the purchase order implies acceptance of full and unreserved of these terms and conditions of sale by the buyer. Evinité reserves the right to modify or to change these terms and conditions of sale. The changes of the general term of sale will be applied to each order placed from the date of the changes.

  1. IV. OUR OFFER

All offers of products, services, delivery terms and prices in Euros (€) are valid in the delivered countries * (* contact us for more information), within the limits of available stocks. Items we sell are described and presented with great accuracy. If, despite all our precautions, errors have occurred, we could not in any way be committed to that fact. The photos and images of the products are not contractual. Except in cases of guarantee, any transaction occurring between Evinité and its customers, not claimed within 7 days after delivery, and cannot raise a claim. Like all food products, ordered bottles can be took back only in their original packaging and unopened. No open bottle can be resumed. Any other application will be rejected. Some products are subject to a minimum purchase amount (eg case of 12, box 3 ...). Appropriate information is given for each concerned product on the website.

  1. V. ORDERS VALIDATION AND ELECTRONIC SIGNATURE

Any order signed by the consumer buy a click, click constituting an acceptance irrevocable, can be claimed only within the limits specified in these Terms of sales. The click is equal as an electronic signature. This electronic signature has value between the parties as an handwritten signature.

  2. 1. Shipping cost calculation

Shipping cost vary depending on the type of transport, place of delivery, the number of bottles ordered and oil increases.

  1. 2. Free transport

Shipping is free for all following wines with the transporter Coliposte : Chateau Ausone (Great wine), Chateau Cheval Blanc (Great wine Chateau Haut Brion (Great wine), Chateau Lafite Rothschild (Great wine), Chateau Latour (Great wine), Chateau Le Pin (Great wine), Chateau Margaux (Great wine), Chateau Mouton Rothschild (Great wine), Petrus (Great wine), Domaine de la Romanée-Conti (Romanée-Conti), Château d\'Yquem (Great wine). The shipping costs are free by Coliposte for all countries deserve by Colisposte for wines above. Evinité will in no way be held liable for any change in legislation intervening in a country.

  1. 3. Transport prices

Those rates are indicative and may be slightly different on the website. In all cases, transport costs are simulated by adding an article to the basket, and selecting the country of delivery and then clicking the OK button.

  1. VII. TRANSPORT TYPE AND DELIVERY TIME

Delivery is made by the carrier selected to the address given by the customer at the time of his order. Delivery times are listed as accurately as possible but can vary depending on supply, transport and climatic conditions (heat and cold).

  1. 1. Delivery time

Delivery times vary depending on the type of transport and place of delivery. The delivery time start from the verification of the customer data and the receipt of payment. These checks will be conducted by Evinité and our bank, CIC-Scalbert Dupont. In any case, delivery must take place within a maximum period of thirty (30) days from the order. If delivery could not be ensured within this period, the customer would be informed at the earliest and might cancel the order. It could then ask a product exchange or a refund. Delivery times are in business days (Monday, Tuesday, Wednesday, Thursday, Friday) and exclude all holidays inherent in some countries. Please find Bellow the delivery times for indicative purposes. Evinité cannot be held responsible for any problems occurring during the transport and beyond its control (included all cases of force majeure, strikes, material damage, natural disaster ...).

  1. 2. Wines available within 10-15 business days.

The order will be shipped in 10-15 days after validation of the order.

  1. 3. Wines shipped within 24 hours.

The order will be shipped within 24 hours if all the wines in the order are 24 hours shipping products. Otherwise, the order will be shipped under the time of the product with the longest time. If you choose the delivery with “DHL Express” and if the order is placed before 12h00, delivery will take place the following day in Europe. (For all products marked with 24 shipping) (Except islands and territories like).
Note: Example: You buy 1 bottle available within 15 days and another available within 24 hours at the same order. The delivery will be shipped within 15 business days.)

  1. 4. Wines available on request

If you choose a wine available on request, delivery time will be indicated on demand. This includes large Champagne formats (Methuselah, Jeroboam, Nebuchadnezzar ...).

  1. VIII. ORDER

If the user is already registered: The order can be registered on the site if the customer is clearly identified, by connecting into the website with his personal account. If the customer is not yet registered: Or by creating an account on www.evinite.com, www.evinite.fr, www.evinite.de, www.evinite.es, www.evinite.ru, www.evinite.cn, www.evinite.se www.evinite.pl
Every order is equal as an acceptance of prices and descriptions of products available for sale. The contract is valid when Evinite will issue a confirmation of the order.
When the order will be validated, it will be forwarded to our logistics department for treatment. The customer will receive in the first hour an automated email of acknowledgment.
Important: Due to numerous frauds and to prevent our customers and ourselves from fraudulent use of credit cards, Evinité may need to request a copy of an official paper (identity card or passport) for any first purchase.   1. IX. STORAGE FEES

Orders not withdrawn within 2 months can be applied to storage costs:
2€ per bottle per month and 1€ insurance per bottle per month. Everything started month is fully due.

  1. X. TRANSPORT AND LIABILITY

The goods are transport at our expense and risk. (The transport insurance is included in our service and for all our deliveries).
However, it is the customer responsibility to check the contents of the package at delivery and make reservations if necessary: either by refusing the package if it was damaged during transport, or specifying clearly and accurately the number and quality of damaged bottles during the delivery. In any case, you must notify Evinité by letter addressed to its registered office (1 rue Marceau Martin - 59128 Flers en Escrebieux - France) within three (3) days after the delivery.
In case of damage during the preparation of orders, Evinité would deliver again or would re found the sum. Your account would be re-credited and Evinité account would be re-charged accordingly. You will be notified by our customer service.
Important notes: Any mention as "Subject unpacking of the parcel" is void of law. It is imperative to check the package at reception and clearly specify the quantity and quality of all wines damaged or broken and if appropriate, deny receiving the package. Any package that would be removed by you is not covered by this warranty and therefore travels at your own risk.

  1. XI. RETURN OF PRODUCT

  2. 1.Your right

Confirm as the Article L. 121-16 of the Consumer Code, you can return at your expense, at our headquarters (1 rue Marceau Martin - 59128 Flers en Escrebieux - France), the product within seven (7) days after delivery for exchange or refund, in good condition, unopened and in its original packaging with a copy of the invoice.
As an exception, this do not apply to order with a customization or a specific request from the customer (special formats, custom packaging ...).
If the ordered products are out of stock Evinité may propose to the customer to replace with his consent, either by another year, or an equivalent wine. If the customer take is right of withdrawal on exchanged the product, the cost of return will be at the expense of Evinité.
Any package that would not match these qualities could be denied.

  1. 2.The costs of return responsibility

Evinité will bear the return shipping product(s) (to base rate in force) only if one of the following two conditions are applicable:
- The delivery is not conform within the request
- Customer has made a reserve to the transporter (see Article X)

  1. XII. OWNERSHIP

Until full payment, Evinité remains the ownership of the goods sold. The full payments will worth transfer of ownership, however, the buyer becomes responsible for items at delivery; transfer of owner ship is valid as transfer of risk.

  1. XIII. PRICE

Prices are quoted in Euros (€) and are listed excluding taxes and shipping charges. These prices are valid but can be subject to typographical and display error. Taxes will be added to the end of the process order:
Delivery – UE (27 European countries: The goods are subject to French VAT 19.6%.
Delivery – Outside the UE: billing will be done without tax. The fees may be required by local customs (VAT, luxury tax, customs ...) in the country of destination. They are not included in the price and are at the charge of the customer.

  1. XIV. PAYMENT AND SECURITY

  2. 1. Payment conditions

The payment of ordered items is to be paid fully to Evinité, at the end of the order process, using one of the following methods:
- Credit card : secure payment online by our bank Banque CIC - Scalbert Dupont. Data Encryption in SSL 128 bits
- Bank transfer : the customer can and we reserve the right to request a bank transfer rather than credit card for security of the transaction and for orders above 5000 € (Euros).
All orders will be valid only at the reception of the full payment. Any order that is not paid in seven (7) days may be canceled without notice.


  1. 2.1 Credit card payment

Payment is done on our bank server fully secure (Banque CIC - Scalbert Dupont Data Encryption in SSL 128 bits). This means that your banking information is never transmitted or hold on Evinité sites. The payment by credit card is perfectly secure. Your order will be validated and registered upon acceptance of the payment by our bank.
All the information you enter on the site to pay our bank CIC - Scalbert Dupont server are automatically encrypted and are transmitted safely to the bank. This payment is completely secure and confidential.
Only the following credit cards are accepted: VISA, VISA, Eurocard, Mastercard or American Express.

  1. 2.2 Bank transfer payment

If you choose the payment by bank transfer, you will find all our bank details on order confirmation sent automatically by email. Visit your bank to operate safely and to process the order. This payment is the safest of all.

  1. 2.3 DATA secure

Your credit card information are encrypted using SSL (Secure Socket Layer) and does not pass unencrypted over the network. Payment is made directly with CIC bank. Evinité has no way to access this information. That is why they are requested again to each new transaction on our site.

  1. XV. LACK OF PAYMENT

Evinité has the right to hold a delivery or to honor an order from a consumer who has not settled completely or partially a payment or with a payment under bank investigation.

  1. XVI. PROFESSIONNAL SALES

For sales professionals, a payment term can be settle by Evinité within the limits prescribed by law from 1 July 1996, based on the quotation.

  1. XVII. RESOLUTION OF THE CONTRACT

If the customer does not pay fully his order, the sale will be cancelled at Evinité will.

  1. XVIII. LAW DISPOSALS « INFORMATIQUES ET LIBERTES »

This website has been registered at the CNIL (Commission Nationale Informatique et Libertés) No. 1203640.
At any time, "you have the right to access, modify, change or delete all data that Concerning yourself" (Article 34 of Law "Computer and Liberties” of January 6th 1978). To respond to your needs and to ensure optimal service , we have to save some of your data (name, address ...).
Evinité guarantee you that the information will never be transmitted to a third party for any reason whatsoever. According to the Data Protection Act of January 6th 1978, you have the right to access and correct all your data. You can edit it online under "My Account" or by contacting our sales department.

  1. 2. Bank information

All banking information you provide to pay your order are transmitted to the secure site of our bank CIC-Scalbert Dupont. Thus, all informations are encrypted SSL 128 bits. These data are not hold by Evinité or visible online. All those information are manage by our Bank. Evinité certify the confidentiality of your data.

  1. 3.Anti-Fraud

In partnership with European anti-fraud cells and banks, our customer service may need to ask a proof of identity and / or home proof of living (identity card, gas bill ...). These data will be needed to process your order and will be at the same confidentiality as the previous information.
The occurrence of an order made with a stolen or fake credit card will lead to the inclusion of all available data related to your command in a file implemented by our bank CIC. A false declarations or anomalies may also be subject to special treatment.

  1. XX. ENTIRETY

If one of those term would be not applicable due to a change of law, regulation, or any other matters. It would not affect the respect of the present term of sales.

  1. XXI. LIABILITY

If the negotiations fail, the following processes will be applied:
This contract is subject to French law. Any dispute arising in connection with the execution or interpretation of this contract will be brought to Evinité headquarters court.
Evinité could not be liable for any inconvenience and damage relating to the use of the Internet as a service break, the presence of viruses or external intrusion or more generally all cases of majeure force qualified by the courts.

  1. XXIV. PROTECTION OF MINORS

According to Article L. 3342-1 of the Public Health Code the sale of alcohol to minors under eighteen (18) years old is prohibited, the buyer agrees, by filling the order, to have eighteen (18) Years old on the date of the order by filling in the appropriate box to his date of birth when creating his account Evinité.
